These Terms of Service ("Terms") govern your use of the website and services of Exclusive Athletic Training ("EAT," "we," "us," or "our"), owned and operated by Derek Kirkland in Savannah, Georgia. By booking a session, registering for a camp or league, or otherwise using our services, you agree to these Terms.
EAT provides athletic training, conditioning, camps, leagues, and related services. Details, schedules, and pricing are described on our website and are subject to change.
When you book a session or register for a camp or league, you agree to provide accurate information. All participants (or their parent/legal guardian if under 18) must complete and sign our Safety & Liability Waiver before participating.
Payment is required as described at the time of booking or registration. Card payments are processed securely by our third-party payment processor. Other payment methods we may accept (such as Zelle, Cash App, or Venmo) are completed directly and confirmed by us. Prices are in U.S. dollars.
Specific deposit, cancellation, and refund terms are presented at the time of booking or registration and, where applicable, in the waiver you sign. Unless otherwise stated, deposits may be nonrefundable, and cancellations within a stated notice window may result in forfeiture of fees. Sessions may generally be rescheduled with advance notice as described at booking.
Participation in athletic activities involves inherent risks. By participating, you (and the parent/guardian of any minor) acknowledge and accept these risks and agree to the terms of our Safety & Liability Waiver, which is incorporated into these Terms by reference.
Participants and guardians agree to behave respectfully and follow the instructions of EAT coaches and staff. We reserve the right to remove any participant whose conduct is unsafe or disruptive, without refund.
With your optional consent (provided in the waiver), we may use photos or video from sessions for marketing and social media. You may decline this at the time of signing.
To the fullest extent permitted by Georgia law, EAT and its owner, coaches, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid for the service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
We may update these Terms from time to time. Changes take effect when posted on this page, and continued use of our services constitutes acceptance.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Georgia.
